THE VIBRATORS: I Kissed A Girl [Single]

With a career lasting thirty-one years, vocalist/guitarist IAN "KNOX" CARNOCHAN, bassist PAT COLLIER, guitarist JOHN ELLIS and drummer EDDIE originally formed the VIBRATORS in February 1976, and their first gig was supporting THE STRANGLERS at Hornsey Art College in North London. They supported THE SEX PISTOLS at the 100 CLUB and were one of the bands playing at the now legendary 100 CLUB PUNK ROCK FESTIVAL, where as well as doing their own set they supported guitar hero CHRIS SPEDDING. THE ORPHANS: Raise The Youth

The Orphans formed in May 1995 in the Philly area...more specifically, in and around the area of West Chester, Pennsylvania. Really the story begins before then, on skateboards in driveways and parking lots while a beat-up tape player crackles and blares in the background. We played basement shows mostly... a few backyards and a whole slew of rentable halls with a lot of bands we became friends with. All in all it adds up to the greatest time of your life: pissed off, carefree, caffeinated and brimming with the relentless desire to get in front of a roomful of dirty, spiky kids around your age and just fucking scream til you can't scream no more. We stopped playing officially in 2000, but have played reunion shows time and again for one reason or another. RANCID & NOFX: [2002] BYO Splits Series Volume III

This 3rd Volume of the BYO Split Series features two of the most infamous punk bands in the world, RANCID and NOFX. The twist on this one is that each band has gone into the studio to record six of the other bands songs. Neither one revealed which songs they were going to do, so the mystery became even more of a reason to get more bold on song selelctions, and the outcome is amazing. The contrasting styles of both bands make the songs that much more interesting, and the self produced efforts bring forth all the energy and fury that punk rock is built on.

FEAR: [1985] More Beer [Restless]

Formed in 1977, the year of punk, Fear sent themselves on a mission to become one of the most relentless and furious hardcore punk bands of all time. They had infamous appearances in "The Decline of Western Civilization" and "Saturday Night Live (SNL)", tearing down the house like nobody else. "More Beer" is the second Album by Fear, which was released after their first smasher "The Record". It has a very strong edge of experimental elements throughout the whole album which gave them a somehow weird but very cool sound.
This is the CD re-issue includes the original recordings of "I Love Livin' in the City" and "Now Your Dead" from the band's first single, as bonus tracks, but omits the song Strangulation.

OPRAH TRADEMARK POWER


We have all heard the power of an Oprah Winfrey product endorsement, or the financial windfall that occurs when Oprah puts you on her booklist. So of course having Ms. Winfrey endorse or even review your product, book, or service is a coveted position by any entrepreneur. Oprah is fully aware of the power of her endorsements, so she is making sure that who she endorses must be accurate, protected, and not diluted by fakes claiming that their products were endorsed by her when they were in fact not.

So Oprah is getting tough and has filed a federal complaint against 50 firms for false association, misrepresentation, trademark infringement, and other claims. After Dr. Memhet Oz touted the benefits of acai berry products, many firms used Oprah and Dr. Oz’s name and image in their advisement creating the impression that Oprah and Dr. Oz endorsed their products when the actually did not.

The lawsuit is Oz. v. FWM Laboratories, Inc. 1:09-cv-07297-DAB; was filed in the Southern District of New York, on August 19, 2009. The complaint states "[t]hese defendants are willfully capitalizing on plaintiffs' valuable reputation and intellectual property rights to lure consumers into ordering their infringing products on the false premise that they have been tested or recommended by Ms. Winfrey and/or Dr. Oz when they have not.”

Oprah is also assisting the Illinois Attorney General in a larger array of investigations which is cracking down on acai berries dietary supplement makers. So far the Attorney General has filed three other lawsuits. Oprah’s lawsuit shows her power of branding and trademark influence.

As a Los Angeles trademark lawyer, I see also several state claims that could be included. As such, Oprah’s New York attorney included claims of trademark infringement, false endorsement, dilution, rights of privacy and publicity under New York and Illinois law, copyright infringement, false advertising under New York and Illinois Uniform Deceptive Trade Practices Act, cybersquatting (to get back various domain names that includes Oprah’s trademarks), unfair competition, and unjust enrichment. So essentially they threw in the kitchen sink of claims, and rightfully so. Oprah is keeping her name and trademarks strong by zealous and diligent enforcement.

Gemballa Unveils the Mirage GT Gold Edition


Here is an option to look forward to for the GT enthusiasts. Gemballa has gone ahead and unveiled the Mirage GT Gold Edition. This edition of the car is based on the Porsche Carrera GT and it continues the legacy of Gemballa Mirage GT variants. The Gold Edition features various gilded accents on the wheels, mirrors, air intakes, side skirts, and wing-which means it is true to its name. The Midas touch is evident even on the inside with gold touches on the instrument cluster, center console, door handles, shifter, and steering wheel.

A more practical equipping includes the HLS suspension which raises the car by 45mm making the car more apt in tackling speed bumps and parking garages. The GT variant is powered by a solid V10 option capable of producing 650 horsepower and 630 Nm of torque. This means that the car can clock 100km on the speedometer in a matter of 3.7 seconds while it has a top speed of 335 km/h.

Henry James and Don Draper


I'm coming clean. I'm standing at the platform and announcing it boldly. I can't stand Henry James. No student of mine will ever have to read him in my class. Here is a sample of what I don't like (from The Golden Bowl, published 1909). Take a deep breath, dear reader:

"He was intelligent enough to feel quite humble, to wish not to be in the least hard or voracious, not to insist on his own side of the bargain, to warn himself in short against arrogance and greed. Odd enough, of a truth, was his sense of this last danger--which may illustrate moreover his general attitude toward dangers from within."

Or this:

"Humble as he was, at the same time, he was not so humble as if he had known himself frivolous or stupid. He had an idea--which may amuse his historian--that when you were stupid enough to be mistaken about such a matter you did know it. Therefore he wasn't mistaken--his future might be MIGHT be scientific. There was nothing in himself, at all events, to prevent it. He was allying himself to science, for it was science but the absence of prejudice backed by the presence of money?


AAAAAAAAAARGH! Now I don't mind working for what I get. And I don't mind a long sentence and I certainly don't mind subtlety. But I'm not crazy about surfing--word surfing, where you have the subject in your hand or the vague idea of what might be important and you're surfing across the rest of the sentence, trying to hold on till you find the verb. Or the connection. Or whatever the hell is going on. Here's another shorter one (always welcome):
"It had been said as a joke, but as, after this, they awaited their friend in silence, the effect of the silence was to turn the time to gravity--a gravity not dissipated even when the Prince next spoke."

Gore Vidal referred to the "marvelous ambiguity" of James. My own quote would be closer to "huh?".

I don't always LIKE ambiguity, you know? I like things right out on the table most of the time. The temperature is 86 degrees. It's August. My birthday is September 12. (still a few shopping days left)

Don't get me wrong. I would far rather read Golden Bowl than any vampire book. Or any sci-fi book or fantasy. Sorry, that's my personal taste.


It's not that James is taciturn like Hemingway, who never tells you anything. You have to figure it out. He once said that his work was 10% above the surface and 90% below. It's amazing that he got away with that, but he did. He is the buried influence of everyone writing today who is told, "show, don't tell."

Here's what that means.

Bob answered the phone angrily.

That's telling.

"Hello!" Bob yelled into the phone and threw it across the room.

That's showing.

Bob shredded the phone into little plastic bits, sharpened his Swiss Army knife to kill his next subway victim, and decided not to answer the phone.

That might be a little of both.


Get it? Adverbs are bad. BAAAAAAAAAAD.

Well anyway, it's not as though James holds back words. He puts in plenty of words. More words than you want to hear. But somehow, the content, to me, gets lost. Somehow, his words are opaque and mysterious. I'm left wondering what he has said.



Jump forward to MAD MEN's Don Draper. He is more of a Hemingway character. He never says much, only occasionally to clients. That's when he shows his soul.

The show is brilliant. Its quality is so high, it's been a while since a TV program got this kind of buzz, probably since The Sopranos. And the clear star is Jon Hamm's Don Draper. He's sexy and handsome in a bone chilling way. I find him cold. Without heart. He's Michael Corleone across town, working in an ad agency.

His wife is Betty. She is a terrible mother, one of the worst. She yells at the kids and has no interest in them. She is cold also and a shell of a person. Thing is, she knows it. She sees a psychiatrist for it. Don doesn't. He thinks he's fine. Betty is as beautiful as Don is handsome. There are many more plots, but I guess what I'm trying to say is the show is very sparely written. They don't say much. And there always seems to be a little lag before someone says something, although that could be me. It's very Hemingway and very un-Jamesian and yet sometimes I don't know what anyone is thinking.

Tension

It's all on Buchholz Does this look like an 80-year-old guy wearing a Red Sox hat and scolding a few young 'uns? I TOLD YOU LITTLE PUNKS TO STAY OFF MY FRONT PORCH! NOW GIT!

Well, it isn't. It's Clay Buchholz, dear reader, 25-year-old pitcher for the team, throwing his hardest. This is what you look like when you are throwing hard.

It makes you realize what tension is.
More and more Little Leaguers are feeling the tension. According to an article in last week's NYT,

Tommy John surgery is becoming more and more common in LITTLE LEAGUERS!

This is tension I just don't like to think about.

This is Nick Bona, pitcher for Peabody (Ma) West, headed for Little League World Series this weekend. I really hope his arm feels good and that he isn't urged to throw more pitches than it will allow. (thanks to Salem News) And of course I hope they win.

According to rivals.com, of the top 100 high school football players entering the 2009 season, ten are from Texas and none are from Massachusetts, Connecticut, Rhode Island, Vermont, or Maine. What's up with that? Are we not big enough? Is a good New England boiled dinner not nutritious enough for the game today?

Nobody would be using illegal substances, would they? No, I'm sure they wouldn't.

One benefit of Brady's time off was that he got to spend more time with his family. He briefly addressed that Thursday. 'I'm a very optimistic person. I cherish those moments,'' he said. 'There have been great things happening in my life for a long time. This year was no different in different areas of success with marriage and with children and it's a great part of my life and so is work. So, I'm excited for all of those things coming together. I think I'm a happier person when I'm working.'
