Heeere's Kitty!






Yes, the Arrival of the Cats has occurred at Camp Becky. They travel pretty light, actually, nothing like me, who goes to the Cape packed down like a beast of burden. They don't bring any clothes. No one here will dress them up in little hats and peignoir sets. Nor will they be pushed in a buggy. They don't need bathing suits--when the toilet bobbing gets a little boisterous, they just fall in.

So far there has only been one controversy, the Where Do We Get to Sleep battle, or Why Can't We Sleep On Your Bed In The Exact Same Spot As You imbroglio. I started the first night by locking them out of the bedroom. It worked fine. They were disoriented anyway and didn't know which way was what. By the second night, they knew where I was and wanted in. A little
scratching on the door but not for too long. By the third night, intense scratching and brutal clawing of the carpet under the door.






They won.









YOU'RE NOT TALKING ABOUT US, ARE YOU? WE WOULD NEVER ACT THAT WAY--NOT KNOWINGLY. LOOK HOW NICE WE ARE.

They're casual about it now and don't rub it in, so that's good. One thing I admire about cats is their total change of attitude (TCA) now and then. They will be doing a no-holds-barred NASCAR circuit around the house, 600 mph, up and down the stairs in a blinding flash, and then all of a sudden TCA. They come to a complete stop, yawn, and then sroll across the room with another yawn. YEAH? WHAT?




This is their high-tech rest room.
The thing has a hydraulic lift in it and you can hear it at night sometimes. It's not quite as romantic as the far-off sound of a locomotive, but comforting in its way.







They are settling into a comfortable routine. I think they are writing a book. I fear it may be a tell-all expose of my house. Gulp.

Domain Name Dispute of googblog.com With Google’s Trademark

Google came out victorious in a cybersquatting case against the owner of googblog.com. Just who owned googblog.com? A 17-year-old boy named Herit Shah from Gujarat, India. Google filed the dispute through the World Intellectual Property Organization (“WIPO”), claiming that googblog.com is confusingly similar to Google’s trademarks.

Further, Google uses ‘GOOG’ as their NASDAQ financial stock ticker since 2004. Google claims trademark rights to the term ‘Google’ as far back as 1997.

Google’s domain name dispute lawyer got Shah to admit “I was in a bad faith that i can legally keep the domain googblog.com but when i kept myself in the place of google i understood i really did very unfair to google. since two weeks i have been trying to delete the domain googblog.com, but i am unable to because godaddy has put my domain on hold, on your consent godaddy may delete the domain or unhold it. I sincerely apologise to Google for infringement, misuse of their intellectual property (GOOGBLOG.COM).”

Pre-litigation negotiations between the Google and Shah failed. Google was only victorious when it was forced to file the Complaint through WIPO. That’s why it’s critical to discuss domain name disputes early with your domain name dispute attorney. See Google Inc. v. Herit Shah

UK SUBS: Left for Dead - Alive in Holland '86 [ROIR]

Once a major player in the second British punk explosion of 1979-1980, the UK Subs still retain a cult following whose tastes never left that era. This factor, coupled with singer Charlie Harper's boundless perseverance, has enabled the UK Subs -- short for "United Kingdom Subversives" -- to outlast first-generation peers like the Clash and Sex Pistols. Never a real presence in America, Harper's profile received an unexpected boost there from Guns N' Roses' inclusion of "Down on the Farm" on its dubious punk covers album, The Spaghetti Incident. Harper's own musical history stretches to the early '70s, with combos like Charlie Harper's Free Press and the Marauders. His career is an anomaly, by any measure; how many middle-aged former hairdressers are fronting punk groups with ever-fluctuating lineups? Left for Dead reissues a cassette-only recording of a 1986 gig first taped in Holland. Immediacy is the name of the game here, a point driven home by the cover packaging ("23 Songs! 60 Minutes!") and Harper's breathless delivery; he remains a presence unto himself, even if he is the sole surviving original member onstage. The band's style is agreeably diverse within punk's bass-drum-guitar constraints, a reflection of its flirtations with melodic punk (Another Kind of Blues(X), 1979), glossy experimental pop (Endangered Species, 1981), and primal proto-metal (Flood of Lies, 1984). Songs aim darts at cops ("CID," "New York State Police"), broken romance (the affecting "Fear of Girls"), rock biz hypocrisy ("Limo Life"), nuclear holocaust ("Warhead"), and homelessness (the sardonic "I Live in a Car"). The crowd howls along to every chorus, supplying an atmosphere airbrushed from the standard artfully dubbed live album. So do Big Takeover editor Jack Rabid's liner notes, which could have stood some updating (even while they cheerfully recount that Harper led three completely different bands in the years before Left for Dead's release). The UK Subs' persistence is unlikely to change the big-time rock scene, let alone their lowly cult stature, but punk fans will find plenty of delights here.

IN MY EYES: [1998] The Difference Between [REVELATION]

Boston hardcore quintet In My Eyes was formed in early 1997 by vocalist Sweet Pete, guitarists Jeff Neumann and Anthony Pappalardo, bassist Damian Genuardi and drummer Luke Garro. Signing to Revelation, the band issued their debut effort The Difference Between in 1998; Nothing to Hide followed two years later. In My Eyes is one of the few bands in the hardcore world that is creating new sounds and reviving a genre that has seen little change over the past decade. A professed Straight Edge band, In My Eyes takes positive messages, interweaves it into their heavy handed guitar tracks. "Why is it you can ruin everything we've made with one touch? And all the effort you waste lashing out...could get something done / I'll stay focused, you stay lost, " sings Sweet Pete on "The K.O.S.T." Anthony Pappalardo and Neil St. Clair add distorted rhythm along with a range of experimental guitar work, while bassist Damian Genuardi quietly lays down a foundation of basslines for the rest of the band to build on. In My Eyes is part of a new crop of hardcore bands that are reenergizing the genre. No longer are groups coming strictly from New York circuits. Instead bands are coming from all over the country, and they're offering a unique take on the classic style of hardcore.

12 CENTS FOR MARVIN: [2001] King of the Ring [CD BABY]

Twelve Cents for Marvin was formed by a group of Colorado State University students in Ft. Collins, CO, in late 1996 and early 1997. According to the liner notes of their debut album, the band got its unusual name when they went to Denver to see a concert and it was canceled. Walking around Denver, they came upon a vagrant named Marvin, who insisted they give him 12 cents. Twelve Cents for Marvin has a unique sound. It's as if a psychedelic band like Love invited a ska-tinged horn section to play for them. Their versatile instrumentation allows them to perform an unusually wide variety of music most bands usually need to bring in session musicians to create.

Three willfully geeky guys from New Jersey who play pop-punk with speed, power, and a mighty smirk (which occasionally belies the fact they sometimes mean what they say), the Ergs (or, as they like to call themselves, "The Near-Sighted Three") came together in 2000, with Jeffrey Erg (Jeff Schroeck) on guitar and vocals, Joey Erg (Joe Keller) on bass, and Mikey Erg (Mike Yannich) on drums and lead vocals. The band wasted no time preserving their music for posterity, putting out two self-released CD-Rs in their first year as a band, but the group first attracted attention outside their peer group with the five-song Three Guys, Twelve Eyes EP, released by the Whoa Oh label in 2001. In a bid to raise their profile by being sued, the Ergs next issued The Ben Kweller EP in 2002. It borrowed the artwork from Kweller's disc EP Phone Home and featured a song poking less-than-charitable fun at the indie rock protégé. In 2003, the Ergs put out their first full-length album, Dorkrockcorkrod, which earned enthusiastic reviews in the punk press and spread word about the band outside of their home state. After an initial release on Whoa Oh, the album was picked up by Don Giovanni Records, which distributed the Ergs' next EP, 2005's Jersey's Best Prancers (whose title and artwork was a play on the 1997 Lifetime album). In 2006, the group was chosen to back Dave Parasite of The Parasites as he launched a tour to support a Parasites best-of CD, and they signed with Dirtnap Records, which scheduled the band's second full-length album, tentatively called Upstairs/Downstairs, for the spring of 2007.

NRA: Machine [GEARHEAD Recs.]
Sixth go-round for veteran Dutch punks NRA is aptly titled - first song "Why Did I Listen To You" fairly busts out of your speakers like that snarling fumetti android Ranxerox from Heavy Metal and proceeds to batter you around the room for the next fifteen tracks with a potent left-right combo of boundless energy and Black Flag/Husker Du-style hooks. But also like dear old Ranx, there's a heart bristling under that leathery hide, and you can hear it beat in frontman Aziz's war-weary vocals, and in the band's relentless drive (boosted again by Dutch engineer supreme Menno Bakker), which hasn't flagged much over its fifteen-year history. Sometimes taking a punch can be the best thing you can do to clear your head, so if the armies of faceless punk outfits have you in a haze, step up to NRA and let them clean your clock. You'll thank us for it later.

Sonia Sotomayor an Intellectual Property Attorney?

It turns out President Obama’s nominee to the Supreme Court was a partner at a firm that handled intellectual property litigation. In fact she ruled on an important copyright case, Tasini vs. New York Times, while she served as a federal judge for the U.S. District Court of the Southern District of New York. However, the case was later reversed by the appellate court and was then appealed again by the U.S. Supreme Court, in New York Times Co v. Tasini 533 U.S. 483 (2001). The case involved a claim of copyright infringement brought by freelance journalists against the New York Times and other news organizations (the “publishers”), when the publishers distributed articles written by the journalist to Lexis/Nexis, a legal database, without the permission of the journalist. The publishers claimed a privilege accorded collective work copyright owners by §201(c) of the Copyright Act.

At the District Court level, Sotomayor ruled in favor of the publishers, claiming that they were entitled to reproduce the articles within Lexis/Nexis under the protection of the collective work copyright. (The collective copyright entitles the copyright owner rights to the collection as whole, but not to the individual authored works which are separately copyrighted works). However, both the appellate court and the U.S. Supreme Court reversed Sotomayor’s decision ruling in favor of the freelance journalists.

The Supreme Court reasoned that as the articles appear in Lexis/Nexis, they do not appear as a collective work, rather “[w]hen the user conducts a search, each article appears as a separate item within the search result.” The Court further stated “the Database does not reproduce and distribute the article ‘as part of’ either the original edition or a ‘revision’ of that edition."

This is what we see before we actually get in the car and go to Gates Pond. Aren't they stunning? I have zero gardening skills, but these rhodies manage to grow and infiltrate their way into more than their allotted space without my assistance.
They only bloom for about two weeks and it used to be far later in May than it is now. Sniff. Boo. Oh well.

This is the same trip I used to take with the illegal squirrel trap in my trunk, live victim inside and waiting for liberty. Not any more, though. I have seen the light. I've also seen the possibility of being, uh, detained by the Animal Officer and I ain't messin' with her.

This is a walk around a pond, not escape from Alcatraz, okay? Thanks, dear reader, I know you know that.
These are lady's slippers, or perhaps they are ladies' slippers. They are, what is that term, endangered. You can't pick them. It's sort of like the mattress tag, though. Who's going to see you do it? And the term itself invites a smile. I picture the little flowers being surrounded by masked gardeners with guns. Yeah. With ransom notes. Now that's endangered. My friend Chris says lady's slippers have an "anatomical" look. We're not saying whose anatomy, however. We're far too dignified and discreet and squeamish for that, but if you have something like this curled up inside or dangling outside your body, keep it to yourself, okay?




Halfway around. Gosh, that went fast!! No sign of any bad guys.







Don't step in this, though. It's potent. I'm beginning to feel like Marlon Perkins.

While Jim wrestles with the vicious anaconda, I can't seem to find my contact lens.
